The Federal Motor Carrier Safety Administration (FMCSA) says that the exemption applies at the point in time when the rest break becomes mandatory and the load is oversize/overweight under permit.

FMCSA further stated that the exemption would not apply to most deadhead (return) trips because the vehicle would generally not be operating under an oversize/overweight load at the time the break becomes mandatory. Additional information can be found here.
